On Monday, September 11, 2023, Town Council refused the application for an official plan amendment and zoning by-law amendment submitted by (Dunpar Developments Inc.) Lisa and Taylor Rogers under sections 22 and 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended.

The purpose and effect of the proposed official plan amendment and zoning by-law amendment is to permit the redevelopment of 1020 – 1042 Sixth Line for 57 new residential units, comprising of 55 townhouse units and a semi-detached unit (2 dwelling units) together with the retention of the detached dwelling related to 1042 Sixth Line. Access to the development is proposed from Sixth Line and from Sunnycrest Lane.

Council refused the application on the recommendation of town staff based on the reasons set out in the Staff Report dated August 29, 2023.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. Copies of the appeal forms are available from the Ontario Land Tribunal website.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council or a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

The decision of Council is final if a notice of appeal is not received before or on October 16, 2023, the last day to appeal.
